Grounds for Divorce in Valencia & Santa Clarita Valley
California is strictly a "no-fault" divorce state, meaning you do not need to prove wrongdoing by your spouse to obtain a divorce. The primary grounds for divorce are irreconcilable differences that have led to the irreversible breakdown of your marriage.
The only other legal ground for divorce under California’s Family Code Section 2310 is the permanent legal incapacity to make decisions, which is rarely used.
California’s no-fault rule is designed to streamline the divorce process. It allows you to dissolve your marriage without the need to prove fault or assign blame, thereby reducing the emotional and financial strains often associated with divorce proceedings.
Uncontested vs. Contested Divorce
Divorces can be uncontested or contested, meaning that spouses agree or disagree on all related issues. Uncontested divorces can proceed much faster because they do not require additional dispute resolution, whether through mediation or a trial.
Uncontested divorces can become even more streamlined through a “Summary Dissolution,” designed for couples who meet specific criteria. This expedited process is less complicated, typically quicker, and less expensive than traditional divorce proceedings.
To qualify for a summary dissolution, both spouses must meet the following requirements:
Filing for Dissolution of Domestic Partnership
Partners who qualify can file a "Petition for Dissolution of Domestic Partnership" in the appropriate county court to dissolve a domestic partnership. Like divorce, one of the partners must have lived in California for at least six months and in the filing county for at least three months before initiating the process.
