What Is the Divorce Process Like in California?

Filing for divorce can be stressful at the best of times, but if you’re not familiar with the process or what to expect, it can be even harder. While your California divorce lawyer will be able to explain everything to you and help you navigate the ins and outs of the legal process, it’s still helpful to familiarize yourself with the steps you’ll need to take. Here’s what the typical divorce process looks like.

File and Serve the Divorce Papers

The first step to initiating the divorce process is to file for divorce. By filing, you’re telling the court and your spouse that you want to terminate your marriage. You’ll need to provide some basic information about your marriage including how long you’ve been married and the types of resolutions you want the court to help with. This may include things like custody, spousal support, and more.

Once you file, you’ll need to provide your spouse with a copy of the papers and give them the opportunity to respond.

Provide Financial Disclosures

As part of the divorce process, you’ll need to provide the court with your financial information. This may involve providing them with copies of your bank account statements, investment account statements, your mortgage information, and any other key financial information you may have. The court needs to have a full understanding of the assets you and your spouse share as well as your finances before they can set the terms of your divorce.

Receive and Follow Temporary Orders

Often, the court will issue temporary orders before you go to court to have your case heard and settled. These orders need to be followed as closely as possible. Your California divorce attorney will be able to clarify any terms that are unclear and may help you contest any terms that seem unfair.

Go to Court

A judge will review your case and determine who receives which assets as well as the general terms of your divorce. And to receive those terms, you’ll need to appear in court. During that hearing, your attorney will represent your interests and may argue for certain terms. This is your opportunity to explain your needs and preferences to the court.

Finalize the Divorce

After going to court, your divorce will be finalized, and you’ll be free to move on with your life. Keep in mind that you’ll still be expected to adhere to any terms the judge sets. If you violate those terms, your spouse may have the right to take you back to court to contest your actions before the judge.

Every Case Is Different

Keep in mind that this is just the general process that most divorces follow. Every divorce is different and unique. That’s why it’s so important that you work with an experienced California divorce lawyer. Your attorney will be able to represent your interests and argue on your behalf. Even better, they’ll be able to give you advice and can spare you some of the stress of filing for divorce.
